Belowtown Terms of Use

These terms are an agreement between you and WileyWorx LLC ("we") for the Belowtown app and website. By using Belowtown you agree to them. They work alongside Apple's Licensed Application End User License Agreement; if the two conflict about the app, these terms apply between you and us.
1. What Belowtown is — and isn't
Belowtown shows the subway, buses and ferries of the New York area in 3D, with live and scheduled times, directions, alerts and rider reports. Transit data comes from public feeds and from riders and can be late, incomplete or wrong. Depths and station interiors are partly modelled. Always follow official signs, announcements and staff, use your own judgement, and never use the app in a way that puts you or others at risk (for example, on platform edges or while driving). In an emergency call 911.
2. Belowtown Plus (subscription)
- The core map, live trains and buses, directions, alerts, station details and rider reports are free. Belowtown Plus adds features such as Home & Work leave-by alarms, live delay notifications for your routes and lines, and trips the app learns from your habits. The App Store page and the purchase screen show what is included.
- Plus is available monthly or yearly. Prices are shown in your local currency before you buy and may vary by country.
- New subscribers may get a free trial. If you do not cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
- Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel any time in your iPhone's Settings › your name › Subscriptions. Cancelling stops the next renewal; you keep Plus until the end of the period you paid for. Refunds are handled by Apple under its policies.
- Restore a purchase on a new device with "Restore purchases" on the Plus screen.
3. Community rules
When you post a rider report, a note, a suggestion or a shared-trip name, you agree to:
- Report only what you actually see, at that station, now.
- Post nothing hateful, harassing, threatening, sexual, violent or discriminatory, and no slurs.
- Post no personal information about anyone — no names, faces, phone numbers, emails, social handles or links.
- Post no ads, spam or anything illegal.
- Not misuse the app to mislead other riders or flood it with reports.
There is zero tolerance for objectionable content or abusive users. Notes are filtered automatically; any rider can report a post; reported posts are hidden and reviewed, normally within 24 hours. We may remove anything and block any device from posting, without notice. Report a problem from the post itself ("•••") or by email.
4. Your content
You keep ownership of what you post. You give us a worldwide, royalty-free licence to use, edit, display and distribute it in Belowtown and to improve our maps and data. Approved suggestions may be changed by us and shown without credit to you. Crew points and levels have no cash value and can be changed or reset.
5. Our app
We give you a personal, non-transferable licence to use Belowtown on Apple devices you own or control. Don't copy, reverse engineer, scrape or resell the app or its data, or interfere with its servers. The Belowtown name, design, 3D models and depth dataset belong to WileyWorx LLC. Third-party data remains its owners' (see the in-app "About" screen). Belowtown is not affiliated with the MTA or any transit agency.
6. Disclaimers and limits
Belowtown is provided "as is", without warranties of any kind. To the fullest extent the law allows, WileyWorx LLC is not liable for missed trains, delays, indirect or consequential losses, or any damages beyond the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
7. Changes, ending, law
We may update the app and these terms; if we make important changes we will tell you in the app. You can stop using Belowtown at any time. These terms are governed by the laws of the State of Montana, USA, except where your local consumer law gives you other rights. Apple is not responsible for the app or its content but is a third-party beneficiary of these terms and may enforce them.
